General terms and conditions for purchases from SUB4life by consumers
Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off period: the period within which the consumer can make use of his right of withdrawal.
- Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the trader.
- Day: calendar day.
- Duration transaction: a distance contract with regard to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
- Durable data carrier: any means that enables the consumer or trader to store information that is personally addressed to him in a way that allows future consultation and unaltered reproduction of the stored information.
- Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period.
- Trader: the natural or legal person who offers products and/or services to consumers at a distance.
- Distance contract: an agreement in which, within the framework of a system organized by the trader for distance sales of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for communication on distance.
- Technology for distance communication: means that can be used for concluding an agreement, without the consumer and trader being together in the same room at the same time.

Article 3 – Applicability
- These General Terms and Conditions apply to all SUB4life offers and to all agreements entered into with the trader.
- In addition to these General Terms and Conditions, Additional Terms and Conditions may, if explicitly indicated, apply to certain services and/or products.
- If, in addition to these General Terms and Conditions, specific product or service conditions also apply, the second and third paragraphs apply by analogy and, in the event of contradictory general terms and conditions, the consumer can always appeal to the applicable provision which is the most favourable for him/her.
- The provisions of these General Terms and Conditions may only be deviated from if this has been explicitly agreed in writing, in which case the other provisions of these terms and conditions shall remain in full force.
- If the consumer also refers to his general terms and conditions, these terms and conditions do not apply unless expressly agreed upon in writing by the trader.
- By consumer means any visitor to the website or any natural or legal person who has or will have a contractual relationship with the trader.
- Trader reserves the right to change or supplement these terms and conditions from time to time.
- By using the website of the trader and/or placing an order, the consumer accepts these Terms and Conditions and all other rights and obligations as stated on the website.
- The trader is entitled to make use of third parties in the execution of an agreement with the consumer.
Article 4 - The offer
- If an offer has a limited period of validity or is made subject to conditions, this shall be explicitly stated in the offer.
- The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly assess the offer. If the trader uses images, these are a true reflection of the products and / or services offered. Obvious mistakes or obvious errors in the offer are not binding on the trader.
- Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer. This concerns in particular:
Article 5 - The Agreement
- The agreement comes into being, subject to that which is stipulated in paragraph 4, at the moment at which the consumer accepts the offer and the conditions thereby stipulated are fulfilled.
- If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of electronic acceptance of the offer. As long as the receipt of this acceptance has not been confirmed by the trader, the consumer may dissolve the agreement.
- If the agreement is created electronically, the trader will take appropriate technical and organizational measures to protect the electronic transfer of data and he will ensure a safe web environment. If the consumer is able to pay electronically, the trader shall observe appropriate security measures.
- The trader may - within legal limits - obtain information about the consumer's ability to fulfil his payment obligations, as well as about all those facts and factors which are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, the trader has good reason not to enter into the agreement, he is entitled to refuse an order or request while giving reasons, or to attach special conditions to the implementation.
- The trader will, together with the product or service, send the consumer the following information, in writing or in such a way that the consumer can store it in an accessible way on a durable data carrier:
In case of a long-term transaction, the provision in the previous paragraph only applies to the first delivery.
Article 6 - Right of withdrawal
- When purchasing products, the consumer has the possibility of dissolving the contract, without giving reasons, during a period of 14 days. This cooling-off period commences on the day after receipt of the product by the consumer or a previously communicated date by the consumer with written agreement by the trader.
- During the cooling-off period the consumer will handle the product and packaging with care. If he exercises his right of withdrawal, he will return the product with all accessories supplied and - if reasonably possible - in the original condition and unopened packaging to the trader, in accordance with the reasonable and clear instructions provided by the trader.

The costs of the return shipment are to be borne by the consumer.

Article 7 - Costs in the event of withdrawal
- If the consumer makes use of his/her right of withdrawal, he/she shall bear the cost of returning the products.
- If the consumer has paid an amount, the trader will refund this amount as soon as possible, but no later than within 14 days after the returned goods arrived at the traders premises.
Article 8 - Exclusion of the right of withdrawal
- The trader can exclude the consumer from the right of withdrawal as far as stipulated in paragraph 2 and 3. The exclusion of the right of withdrawal is only valid if the trader has clearly stated this in the offer, at least in good time before concluding the agreement.
- Exclusion of the right of withdrawal is only possible for products
- that have been created by the trader in accordance with the specifications of the consumer;
- that are clearly of a personal nature;
- that cannot be returned due to their nature;
- that spoil or age quickly;
- whose prices are subject to fluctuations in the financial market that are beyond the trader's control.
Article 9 - The price
- We will send the order as soon as we have received the payment (iDeal, Credit card and Paypal equal and advance transfer as soon as the amount is received). You can expect your order at home within 3-5 working days.
- During the period mentioned in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
- Contrary to the previous paragraph, the trader may offer products or services whose prices are subject to fluctuations in the financial market that are beyond the trader's control, at variable prices. The offer shall state this link with fluctuations and the fact that any prices mentioned are recommended prices.
- Price increases within 3 months after the conclusion of the agreement are only allowed if they are the result of statutory regulations or provisions.
- Price increases from 3 months after the conclusion of the agreement are only allowed if the trader has stipulated it and: a.they are the result of statutory regulations or stipulations;b. the consumer is authorized to terminate the contract on the day on which the price increase takes effect.
- The prices mentioned in the offer of products or services include VAT.
Article 10 - Compliance and Warranty
- The general warranty conditions apply to products supplied by the trader.
- The trader is never obliged to pay any damages to the consumer or others, unless there is intent or gross negligence on the part of trader. The trader is never liable for consequential or company damage, indirect damage and loss of profit or turnover.
- If, for any reason, the trader is obliged to compensate any damage, the compensation will never be higher than an amount equal to the invoice value with regard to the product or service which caused the damage, or to the extent that it is covered by the trader insurance.
- Despite the constant care and attention the trader pays to the composition of the website, it is possible that information published on the website is incomplete and/or incorrect.
- The information on the website is regularly updated and/or modified. The trader reserves the right to make any changes with immediate effect and without notice.
- The consumer is obliged to indemnify the trader for any claim by third parties against the trader in connection with the execution of the agreement, insofar as the law does not prevent the consumer from bearing the relevant damage and costs.
- It is possible that the trader includes in its website links to other Internet sites that may be interesting or informative for visitors. Such links are purely informative. The trader is not responsible for the content of the website to which it refers or the use that can be made of it.
Article 11 - Delivery and execution
- The trader will take the greatest possible care when receiving and executing product orders and when assessing applications for the provision of services.
- The place of delivery is the address that the consumer has made known to the company.
- Subject to what is stated in article 4 of these terms and conditions, the company will execute accepted orders with convenient speed but at least within 14 days unless a longer delivery period has been agreed. If the delivery has been delayed, or if an order cannot be filled or can be filled only partially, the consumer will be informed about this within 14 days after he has placed the order. In that case, the consumer has the right to dissolve the agreement free of charge and the right to possible compensation.
- In case of dissolution in accordance with the previous paragraph, the trader will refund the amount paid by the consumer as soon as possible, but at the latest within 14 days after dissolution.
- If delivery of an ordered product turns out to be impossible, the trader shall make an effort to provide a replacement article. The fact that a replacement article is being delivered will be communicated in a clear and comprehensible manner, at the latest upon delivery. The right of withdrawal cannot be excluded for replacement products.
- The risk of damage and/or loss of products rests with the trader up to the moment of delivery to the consumer or a previously designated and notified to the trader representative, unless otherwise expressly agreed.
Article 12 - Complaint procedure
- The trader has a sufficiently publicised complaints procedure and deals with the complaint in accordance with this complaint procedure.
- Complaints about the implementation of the agreement must be submitted to the trader within reasonable time, fully and clearly described, after the consumer has found the defects.
- Complaints submitted to the trader shall be answered within a period of 14 days, calculated from the date of receipt. If a complaint requires a foreseeably longer processing time, the trader shall respond within 14 days with a notice of receipt and an indication of when the consumer can expect a more detailed answer.
- If the complaint cannot be solved in mutual consultation, a dispute arises that is subject to the dispute settlement procedure.
Article 13 - Disputes
Only Dutch law applies to agreements between the trader and the consumer to which these general terms and conditions apply.
Article 14 - Additional or different provisions
Additional provisions or provisions that deviate from these general conditions, may not be to the detriment of the consumer and should be recorded in writing or in such a way that the consumer can be stored in an accessible manner on a durable data carrier.
Article 15 - Gift vouchers
- The terms and conditions apply to all gift vouchers issued by the trader (both electronic and printed gift vouchers, hereafter jointly "Gift vouchers") that are sold and/or given out by the trader or designated third parties.
- Every gift voucher is provided with a unique code. This can be a number code and/or text code or a combination of these. Every gift voucher is only once strengthened. The consumer must keep the gift voucher including code carefully. In case of theft (including the use by unauthorised third parties of the code) or loss (including the (accidental) deletion of emails) there will be no refund. Only original gift vouchers and codes can be used and must be provided to the trader upon request.
- To use a gift voucher the consumer must place the selected products in the shopping basket. In the shopping basket the consumer fills in the exact code of the gift voucher in the window "Discount code".
- The nature, value, duration, expiry date and/or any other applicable specific terms and conditions of use can be found on the gift voucher. The gift vouchers of Trader have no expiry date, as a result of which they are legally valid for 1 year after the issue date. After this expiry date, the gift voucher can no longer be used.
- Gift vouchers cannot be used for open orders.
- A gift voucher must be paid in one time in one order.
- Gift vouchers are not exchangeable for money.
- If the total amount of the order is higher than the value of the gift voucher used, the difference must be paid with one of the payment methods that are used in the web shop.
- It is not permitted to modify the amount, the code or the issue date, this makes the gift voucher invalid. Every (attempt to) fraud or other not permitted act is registered and leads to the use of the gift voucher denied.
- It is not permitted to use gift vouchers in any way whatsoever for commercial purposes and/or other purposes than for which they have been issued.
- The gift voucher conditions can be modified from time to time.
